Abstract

The Sharia gave wide behaviors to the guardian, and the basic principle of these actions is to be in the interest of the parish, and among the actions of the guardian of the guardian is related to personal status, so this study came to show these actions
The study came in an introduction, and two topics: The first topic dealt with the concept of the vocabulary of the rule in language and reform and its total meaning, and the evidence for it from the Holy Qur’an and the honorable Sunnah, and the second topic dealt with al -Qaeda applications in personal status (marriage contract), in five demands, in which the researcher focused on contemporary images that fall into the powers of the guardian, and relate to public interests
The study came out with several results, including: that the actions of the governors in their parish matters should be related to the interest, and the purposes of Sharia to bring benefit and ward off harm, and every dry behavior of this interest, or that of these purposes, is invalid in Sharia, and a policy return
The researcher showed the emergence of clear behavior of the guardian in the field of personal status and appears in the following: marriage of minors, determining the age of marriage, informing the first wife to repeat the marriage, and obligating the medical examination before the marriage contract, documenting the marriage contract, and obligating the training courses before marriage
