If the error was intentional, it is a crime, but if the error was negligence, it must punish the responsible person, It is certain that Iraqi law addressed this problem, just like penal laws around the world. However, if the medical error was due to a wrong diagnosis, then the doctor must have worked diligently, so the error and the blame are not on him, but on the health institution that granted him a practicing certificate without properly qualifying him. However, if the The error is not intentional, and if the therapist made a commendable effort but did not succeed in stopping the harm (such as death), then he is not to blame. In addition to all of this, it seems that social responsibility requires qualifying the doctor scientifically
