Abstract

Summary

This study dealt with a topic worthy of attention and study in the present era, which is the difference in the arbitration of the mind between the heavenly religions and the positive laws, and the aim of the research to: the statement of the difference in arbitration of the mind between the heavenly religions and the positive laws, and by arbitration of the mind, the mind is preserved, which is one of the fifth necessities that commanded the law Islamic by preserving it, as it made it the regret of the assignment, and thus it is achieved for a person to know the things that remove or obscure the mind, which all the heavenly laws forbade, and the importance of research lies in explaining the position of the mind in Islamic law, and explaining the difference in the arbitration of the mind between the heavenly religions and positive laws.

  In his study, the researcher took on the inductive approach by extrapolating what was previously discussed on the subject of the position of the mind in Islam, and what was not discussed and eaten in the field of arbitration of the mind between the heavenly religions and positive laws, then through previous studies the analytical approach was followed by analyzing what was highlighted In previous studies, the conclusion of common matters between heavenly religions and statutory laws in this part of this study related to the difference in the arbitration of the mind between divine religions and positive laws
