Abstract

The denial of difference is one of the fundamentalist principles that have a great  impact on Islamic jurisprudence. I have seen the focus of its application on the issues of marriage contract and effects without other issues of jurisprudence, to take the study of a new character makes the reader feel the importance of the idea of ​​negating the difference in one section of the doctrine of jurisprudence.

The research included two topics, the first of which dealt with the negation of the difference and its argument with the fundamentalists, while the second topic focused on the applications of denying the difference in the marriage contract and its effects. The application comes to complement the rooting that began research, and confirmed to consider the denial of difference and work by scholars and fundamentalists.
