حكم النمص والوشم في الفقه الإسلامي

ملخص
قامت الدراسة على تبيان الحكم الشرعي لمسألة الوشم والنمص في الفقه الإسلامي وقد عملت الدراسة على تبيان التعريفات لتلك المفاهيم وتبيان أحكامها الفقهية وفق ما جاء في المخارج الشرعية لها، كما ورد في كتب أصحاب الاختصاص وأنواعها ودورها في الحياة المعاصرة وتم التركيز فيها عن موقف الشريعة منها، وقد خلصت الدراسة إلى حقائق ونتائج بأن الوشم والنمص المنهي عنه بالسنة النبوية له مبررات وظروف معينة وهناك حالات ليقتضي حصر هذا الحكم كما في مسألة التجميل وإخفاء التشوهات، فإنه عندها له مبرر شرعي، وأن النهي الذي وجد في الفقه الإسلامي كان لأجل ما يلحق هذه الأفعال من تبعات وأمور خاصة بها. قال الله تعالى : ( إِنْ يَدْعُونَ مِنْ دُونِهِ إِلَّا إِنَاثًا وَإِنْ يَدْعُونَ إِلَّا شَيْطَانًا مَرِيدًا (117) لَعَنَهُ اللَّهُ وَقَالَ لَأَتَّخِذَنَّ مِنْ عِبَادِكَ نَصِيبًا مَفْرُوضًا (118) وَلَأُضِلَّنَّهُمْ وَلَأُمَنِّيَنَّهُمْ وَلَآمُرَنَّهُمْ فَلَيُبَتِّكُنَّ آذَانَ الْأَنْعَامِ وَلَآمُرَنَّهُمْ فَلَيُغَيِّرُنَّ خَلْقَ اللَّهِ وَمَنْ يَتَّخِذِ الشَّيْطَانَ وَلِيًّا مِنْ دُونِ اللَّهِ فَقَدْ خَسِرَ خُسْرَانًا مُبِينًا (119)) النساء / 117 – 119.

ABSTRACT
The study was based on the clarification of the legal ruling on the issue of tattoos and noses in Islamic jurisprudence The study worked to clarify the definitions of those concepts and clarify the provisions of jurisprudence according to what was stated in the exits of legitimacy, as stated in the books of specialists and types and role in contemporary life and was focused on the position of Sharia them, the study has concluded to the facts and results that tattoos and noses forbidden by the Sunnah of the Prophet has justifications and certain circumstances and there are cases to require the limitation of this provision as in the issue of cosmetics Concealing distortions, then it has a legitimate justification, and the prohibition found in Islamic jurisprudence was for the consequences and matters of their own to these acts.
God Almighty said:
(The Pagans), leaving Him, call but upon female deities: They call but upon satan the persistent rebel! View more verses.
Allah did curse him, but he said: "I will take of Thy servants a portion Marked off; View more verses.
"I will mislead them, and I will create in them false desires; I will order them to slit the ears of cattle, and to deface the (fair) nature created by Allah." Whoever, forsaking Allah, takes satan for a friend, hath of a surety suffered a loss that is manifest.
