المستخلص

تناولت هذه الدراسة قاعدة من القواعد الاصولية المتعلقة بأحد أقسام الحكم التكليفي وهو المباح، إذ قامت ببيان لحقيقة القاعدة على وجه الإفراد والإجمال، وبيان أدلة القاعدة من نصوص شرعية تؤصل هذه القاعدة وتُثبت شرعيتها.
كما قمت ببيان الشروط التي يلتزم بها المجتهد لاعمال هذه القاعدة في الواقع المعاصر، كما اهتمت الدراسة أيضاً بإبراز دور القاعدة في استيعاب التطبيقات والنوازل المستجدة، مثبته في ذلك التيسير في هذه القاعدة حيث إنها تعني أن للإنسان أن ينتفع بكل ما سُخّر له في هذه الدنيا ما لم يدل دليل على تحريمه، مثبتة في ذلك أن الشريعةَ الإسلامية شريعةٌ واقعية تواكب حياة الناس وتستوعب جميع القضايا المستجدة، بما يحقق مصالح الناس.

This study dealt with one of the fundamental rules related to one of the sections of the obligatory ruling, which is permissible, as it explained the truth of the rule individually and in general, and explained the evidence for the rule from legal texts that establish this rule and prove its legitimacy.
I also explained the conditions that the mujtahid must adhere to in order to implement this rule in the contemporary reality. The study also focused on highlighting the role of the rule in absorbing new applications and calamities, based on the facilitation of this rule as it means that a person can benefit from everything that has been made available to him in this world. There is no evidence that it is forbidden, proving that Islamic law is a realistic law that keeps pace with people’s lives and accommodates all emerging issues, in a way that achieves people’s interests.
